The actual temporary head of the consumer protection agency, Leandra English, has filed a lawsuit challenging Trump's right to put Mulvaney in that position. I assume that even if she wins, Trump will nominate Mulvaney to be the permanent head. And it doesn't seem like Congress has any intention - or ability - to bar any of Trump's inappropriate agency heads.
