Secret recordings

Liberal activist and documentary filmmaker Lauren Windsor posted the audio on X Monday and shared it with Rolling Stone. In the exchanges, Windsor posed as a conservative hostile to abortion rights and supportive of the Alitos.

Justice Samuel Alito spoke candidly about the ideological battle between the left and the right — discussing the difficulty of living “peacefully” with ideological opponents in the face of “fundamental” differences that “can’t be compromised.” He endorsed what his interlocutor described as a necessary fight to “return our country to a place of godliness.” And Alito offered a blunt assessment of how America’s polarization will ultimately be resolved: “One side or the other is going to win.”

The justice’s unguarded comments highlight the degree to which Alito makes little effort to present himself as a neutral umpire calling judicial balls and strikes, but rather as a partisan member of a hard-right judicial faction that’s empowered to make life-altering decisions for every American.

Similar questions Windsor asked of Chief Justice John Roberts at the same event elicited a far different response.

Roberts takes issue with Windsor’s assertion that the nation is unusually polarized, historically, citing the high tensions of the Vietnam War era, for example. He also insists that the Supreme Court’s current role is not exceptional. “The idea that the court is in the middle of a lot of tumultuous stuff going on is nothing new,” Roberts says.

Pressed on whether the court has an obligation to put the country on a more “moral path,” Roberts turns the tables on his questioner: “Would you want me to be in charge of putting the nation on a more moral path?” He argues instead: “That’s for people we elect. That’s not for lawyers.” Presented with the claim that America is a “Christian nation” and that the Supreme Court should be “guiding us in that path,” Roberts again disagrees, citing the perspectives of “Jewish and Muslim friends,” before asserting, “It’s not our job to do that. It’s our job to decide the cases the best we can.”

In that whacko complaining screed, Martha Ann says the word "vergogna" - and she spells it - saying it means shame.  I don't know why she doesn't just say shame, but Hakeem Jeffries has a nice responsive tweet...

[Martha Alito] the quintessential handmaiden for white Christian nationalism in lipstick and pearls.

In the same recording, Justice Alito warned, “One side or the other is going to win. There are differences on fundamental things that really can’t be compromised,” about the country’s widening divide between the majority who understands the Constitution and the concept of separation of Church and state and the minority that wants to create a Christian theocracy. Instead of keeping her husband in check, recordings of Martha-Ann make her out to be a Christian nationalist Lady Macbeth.

Martha-Ann Alito embarks on a strange, homophobic rant against LGBTQ+ people and doubles down on flying her freaky flags. “I want a Sacred Heart of Jesus flag because I have to look across the lagoon at the Pride flag for the next month,” she tells Windsor. “Oh, please, don’t put up a flag,” Alito replies. She adds she would make up her own flag with yellow and orange flames that read “Shame” in Italian.

Spotlight on Alito

In a lease filed with the Grady County clerk, the wife of Supreme Court Justice Samuel Alito entered into an agreement with Citizen Energy III for revenue generated from oil and gas obtained from a plot of hard scrabble she inherited from her late father. It is one of thousands of oil and gas leases across Oklahoma, one of the top producers of fossil fuels in the United States.

Last year, before the lease was activated, a line in Alito’s financial disclosures labeled “mineral interests” was valued between $100,001 and $250,000. If extraction on the plot proves fruitful, the lease dictates that Citizen Energy will pay Alito’s wife 3/16ths of all the money it makes from oil and gas sales.

In the past, Alito has often recused himself from cases that pose potential conflicts of interest with his vast investment portfolio. Many of these recusals were born from an inheritance of stocks after the death of Alito’s father-in-law, Bobby Gene Bomgardner. Because Citizen Energy III isn’t implicated in any cases before the Supreme Court, Alito’s holding in Oklahoma doesn’t appear to pose any direct conflicts of interest. But it does add context to a political outlook that has alarmed environmentalists since Alito’s confirmation hearing in 2006 — and cast recent decisions that embolden the oil and gas industry in a damning light.

“There need not be a specific case involving the drilling rights associated with a specific plot of land for Alito to understand what outcomes in environmental cases would buttress his family’s net wealth,” Jeff Hauser, founder and director of the Revolving Door Project, told The Intercept.

In May, Alito penned a majority decision in Sackett v. EPA which radically scaled back the Clean Water Act, reducing its mandate by tens of millions of acres.

Prior to targeting the Clean Water Act, Alito joined the courts’ other conservative justices in attacking another set of EPA powers under the Clean Air Act in West Virginia v. EPA. The 2022 ruling gutted the EPA’s ability to regulate greenhouse gas emissions from power plants.
