Ruling on Mar-A-Lago warrant affidavit
...but hey, do what you want...you will anyway.Magistrate Judge Bruce Reinhart just accepted DOJ’s proposed redactions in the Donald Trump affidavit and ordered them to post it by noon ET tomorrow.
According to his order, DOJ will redact:
(1) the identities of witnesses, law enforcement agents, and uncharged parties,
(2) the investigation’s strategy, direction, scope, sources, and methods,
(3) grand jury information protected by Federal Rule of Criminal Procedure 6(e).

There they were stored at various points over the past 19 months in different locations inside Mar-a-Lago, Mr. Trump’s members-only club, home and office.

McGahn II, Mr. Trump’s first White House counsel, instituted a protocol for the proper handling of materials and gave presentations on the law to staff members, former officials said. After the 2020 election, White House officials held conversations about the fact that someone needed to retrieve documents that Mr. Trump had accumulated in the residence over many months.

The Christian right and its GOP allies are counting on their base consuming a steady diet of these radio shows, podcasts, social media posts, and email blasts, tuning out any coverage that conflicts with their image of Trump as both a virile hero and a victim besieged by radical leftists at the FBI.

When the FBI stormed former President Trump’s Mar-a-Lago estate in Florida on Monday, agents were confronted by his attorney Christina Bobb, an ex-U.S. Marine and a former anchor on the far-right news network One America News (OAN).

“I’m a little bit befuddled as to why they would do such a drastic thing, so disrespecting and so dishonoring, other than the fact it’s a political tool,” she said.
Bobb also said there was “not anything there” for the FBI to find, claiming the investigation would not yield any damning results against Trump.

Nonetheless, she insisted that the government's search "was an appalling display of abuse and power — complete overkill." She also asserted that "if they needed documents, they could have asked. There's never been an issue with compliance." Halligan said the search came as a "huge surprise."

New York State Supreme Court Judge Arthur Engoron brought all the parties together in a Zoom conference to hear everyone's positions. In his corner, Trump had someone who was far from the national radar: a 36-year-old lawyer named Alina Habba.
At times, Habba treated the court hearing like a Fox News appearance, inquiring why the New York state Attorney General's office would not investigate Hillary Clinton instead of Trump. Engoron's law clerk told her several times to stop interrupting him.
In the end, Engoron ordered Trump, Donald Trump Jr, and Ivanka Trump to sit for depositions within 21 days. Habba's arguments didn't work.

A lawyer for Donald Trump is being accused of "racist" office behavior by an ex-employee, including allegedly shouting "I hate that Black bitch!" about the New York Attorney General Letitia James after losing a court case.
The New Jersey-based attorney, Alina Habba, is also on tape dropping "N" bombs while rapping bombastically along to gangsta rap recordings that blasted in her Bedminster law offices, according to the lawyer beyind a lawsuit filed this week in Middlesex County, New Jersey.
The audio tapes — duets, apparently, which also feature Habba's law partner Michael Madaio rapping along — may become public as part of her client's new lawsuit, said Jaqueline Tillmann, the Princeton lawyer repping former Habba employee Na'Syia Drayton.
"We are contemplating amending the complaint and adding one or two of the recordings as exhibits," Tillmann told Insider Thursday.

FBI search of Mar-A-Lago affidavit release uncertain
Hillary Clinton would like a word.With Trump weighing a comeback bid for the presidency, the Mar-a-Lago matter also presents great risks for the Justice Department, where Attorney General Merrick Garland has already made a break from history by agreeing to release the search warrant itself. Though institutionalists within DOJ are unlikely to welcome efforts to unseal even more details — a fact underscored during Thursday’s hearing — Garland has already made clear the Trump probe is unique and may warrant more disclosures than the department typically allows.
At Thursday’s proceedings, the Justice Department’s top counterintelligence official, Jay Bratt, repeatedly emphasized that the investigation into the former president’s handling of classified White House records “is in its early stages.” Magistrate Judge Bruce Reinhart, who authorized the search on Aug. 5, ordered prosecutors to propose redactions to the affidavit by next week, indicating that he was skeptical of the Justice Department’s arguments to keep those documents under seal. He set a deadline of next Thursday for prosecutors to propose redactions to the affidavit.

But Reinhart also signaled he would likely allow significant redactions, and a final resolution on the issue of public access to the pivotal court filing may still be a long way off.

And the judge indicated he may also hold a closed-door hearing on the matter with prosecutors if he opts against keeping the entire document under seal. Trump had earlier called for the release of the search warrant, only to result in Garland unexpectedly doing so. In the process, it was revealed that the FBI was investigating potential violations of the Espionage Act and the Presidential Records Act, as well as obstruction of justice.
There remains, moreover, no indication that Reinhart will agree to the type of disclosure Trump’s team is demanding. DOJ has indicated that the release of the affidavit might compromise witnesses who helped form the basis of their suspicions.

An armed man was shot and killed by police last week after he attempted to attack an FBI office in Cincinnati, and a Pennsylvania man was arrested earlier this week after threatening to kill FBI agents.

Judge may require DOJ release affidavit in support of Mar-A-Lago search
I suspect the affidavit will be highly redacted. But I also suspect that Trumpists will use it to attempt to go after anyone they suspect of cooperating with the DOJ. They're looking for who might have told the FBI where to find illegally retained files.

The former president returned 15 boxes of material to the National Archives in January, but the Justice Department issued a subpoena in May for documents that were still at his residence. On June 3, counterintelligence officials with the Justice Department’s national security division went to Mar-a-Lago to collect remaining documents with classified markings.
At that point, at least one Trump lawyer signed a statement saying material with the classified markings had been returned, according to four people familiar with the document. But officials then used a subpoena to obtain surveillance footage of the hallway outside a storage room at Mar-a-Lago and saw something that alarmed them. They also received information from at least one witness who indicated that more material might remain at the residence, people familiar with the investigation said.

Marjorie Taylor Greene (R-Ga.), using her official congressional account since her personal Twitter was suspended in January over COVID-19 misinformation, told her 1 million followers Monday that “Republicans must force” the “political persecution” to stop. Greene filed articles of impeachment against Attorney General Merrick Garland last week.

Declassified my ass
In response to Harry Litman, to be fair, this was Trump's OLC we're talking about.
At any rate, no one outside crazy MAGA would believe that Trump's "work" involved 27 boxes of classified documents. Besides, his home was the west wing. (And per his statement about taking "work" to the residence: that's not Mar-A-Lago. That's clearly the west wing.)
Also, whatever his work was in regard to classified information, what is his reason for keeping the documents after he left office? After he was asked to return them? After he was subponaed for their return?
Jesus, these people.

The areas allowed to be searched according to the warrant are much more extensive than originally reported.The first receipt lists out 28 numbered items, including some that have sub-headers. Some of the items are actually named like item number 1 which says it was an “Executive Grant of Clemency re: Roger Jason Stone, Jr.” or 1A which says it is “Info re: President of France.”
Others like item number 2 are less specific. That item says it is a “Leatherbound box of documents.” Item 2A says it contained “Various Classified/TS/SCI documents.”
Item number 3 says it was a “potential presidential record,” and items numbers 5 and 6 both say they were a “binder of photos.”
Item number 7 says it was a “handwritten note,” and items 8, 9, and 10 were boxes labeled A-1, A-12, and A-15 respectively. Item 10A specifies that that item allegedly contained “Miscellaneous Secret Documents.”

Specifically, it says that agents could search the “45 Office,” and “all storage rooms, and all other rooms or areas within the premises used or available to be used by” the former President of the United States [the document uses the abbreviation FPOTUS] “and his staff and in which boxes or documents could be stored, including all structures or buildings on the estate.” This attachment does however said agents are not authorized to search areas “currently (i.e., at the time of the search) being occupied, rented, or used by third parties (such as Mar-a-Lago members) and not otherwise used or available to be used by FPOTUS and his staff, such as private guest suites.”

The link between Reinhart and Epstein has been weaponized by Trump supporters to incorrectly imply Reinhart was Epstein’s own lawyer, and, by extension, was corrupt and possibly a pedophile.
