U.S. President Joe Biden is able to skirt congressional opposition to Ukraine aid by donating weapons to Greece with the expectation that Greece will then donate its own surplus equipment to Kyiv, according to a Jan. 30 report published in Forbes.

A U.S. legal authority known as Excess Defense Articles (EDA) allows the president to deem certain weapons systems surplus and transfer them to partner nations at a cheap price or without cost.

Smartmatic isn't stopping with Fox

In the wake of the 2020 election, the president of the far-right network One America News sent a potentially explosive email to former Trump campaign lawyer Sidney Powell, with a spreadsheet claiming to contain passwords of employees from the voting technology company Smartmatic, according to court filings.

1. Trump Organization (generally ill-gotten gains)
2. His duped supporters 
3. Jared's Saudi funding
4. Trump's personal finances

25 historians file amicus brief supporting 14th amendment disqualification

The 25 historians – among them James McPherson of Princeton, the pre-eminent civil war scholar – pointed to 1860s congressional debate.

“Senator Reverdy Johnson of Maryland, a Democratic opponent of the 14th amendment, challenged sponsors as to why section three omitted the president. Republican Lot Morrill of Maine … replied, ‘Let me call the senator’s attention to the words “or hold any office civil or military under the United States”.’ Johnson admitted his error; no other senator questioned whether section three covered the president.”

The historians also cited Andrew Johnson, in 1868 the first president impeached, referring to himself as “chief executive officer”.

It's a ridiculous argument that the president is immune because he's not an officer of the US, but I wouldn't put anything ridiculous past this Supreme Court.
Pointing out that section 3 of the 14th amendment is self-executing, and that “no former Confederate instantly disqualified from holding office under section three was disqualified by an act of Congress”, the historians also noted that Jefferson Davis, the Confederate president, cited his own disqualification as reason an indictment for treason should be quashed.

“Contemporary information provides direct evidence of the enduring reach of the 14th amendment,” the historians wrote. “Congress … chose to make disqualification permanent through a constitutional amendment.

“Republican senator Peter Van Winkle of West Virginia said, ‘This is to go into our constitution and to stand to govern future insurrection as well as the present.’ To this end, the Amnesty Acts of 1872 and 1898 did not pardon future insurrectionists.”
So the rotten SCOTUS also has the path of saying Trump did not incite or commit insurrection, which would directly contradict the Colorado courts.
The historians also said “adverse consequences followed” amnesty, many ex-Confederates winning office and “participat[ing] in the imposition of racial discrimination in the south that vitiated the intent of the 14th and 15th amendments to protect the civil and political rights of the formerly enslaved people.”

The historians concluded: “The court should take cognisance that section three of the 14th amendment covers the present, is forward-looking, and requires no additional acts of Congress for implementation.”

"To attack the court and the attorney-general in personal terms at every opportunity," likely gave rise to the court imposing the harshest possible financial penalties, Mr Epner said.

Emergency border deal


President Joe Biden on Friday urged Congress to pass a bipartisan bill to address the immigration crisis at the nation’s southern border, saying he would shut down the border the day the bill became law.

“What’s been negotiated would — if passed into law — be the toughest and fairest set of reforms to secure the border we’ve ever had in our country,” Biden said in a statement. “It would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”

Some post-award analyses


To have a meritorious appeal, you have to preserve a reversible error at the trial level. This is why you hire competent counsel. You need someone who actually knows the rules of evidence and procedure.

Alina Habba had no clue what was occurring throughout the trial. She not only failed to preserve any remote grounds for appeal, like a moron, she repeatedly and unintentionally waived them over and over.

For example, she kept saying "no objection" as exhibits were entered into evidence.

Or, Mr. Trump can try to secure a bond, which will save him from having to pay the full amount up front.

A bond might require him to pay a deposit and offer collateral, and would come with interest and fees. It would also require Mr. Trump to find a financial institution willing to lend him a large sum of money at a time when he is in significant legal jeopardy.

The court-appointed monitor overseeing Donald Trump's businesses told a judge on Friday that the former president's financial information has contained "incomplete" or "inconsistent" disclosures containing "errors."

"I have identified certain deficiencies in the financial information that I have reviewed, including disclosures that are either incomplete, present results inconsistently, and/or contain errors," former federal judge Barbara Jones, tasked with scrutinizing the former president's business empire, wrote in a 12-page letter.

Last September, Engoron issued a ruling dissolving Trump's New York business empire for "persistent" fraud.
