The $175 million bond in former President Trump’s civil fraud trial is at risk after the New York attorney general’s office questioned the qualifications of the California-based company that posted it.

State lawyers wrote in a brief court notice Thursday that they take “exception to the sufficiency of the surety,” secured from Knight Specialty Insurance Company.

The notice requires Trump or the insurance company to demonstrate that the company is financially capable of paying the bond amount if Trump loses on appeal and that the bond is appropriately collateralized.

The New York attorney general’s office separately asked Engoron on Thursday to direct the independent monitor he appointed to oversee the Trump Organization’s business dealings — one of the penalties he imposed — to investigate whether the defense “withheld relevant and responsive information” during the trial.

Former President Donald Trump made a series of false claims on Tuesday while railing against the judge who issued the $454 million civil fraud judgment against him.

Trump posted the claims on social media the day after his lawyers said in a court filing that he had been unable to persuade any company to provide the appeal bond he needs in order to stop New York Attorney General Letitia James, who filed the successful lawsuit against him, from beginning to collect on Judge Arthur Engoron’s judgment.

Trump baselessly accused Engoron and James of corruption and wrote that they are “asking me to put up massive amounts of money before I am allowed to appeal the ridiculous decision. Never done before.” He also claimed that Engoron “wants me to put up Hundreds of Millions of Dollars for the Right to Appeal his ridiculous decision” and that “Engoron wants me to put up the ridiculous fine (I DID NOTHING WRONG!) before I get a chance to Appeal his crazed ruling - A first!”

Trump’s claims are comprehensively untrue. He is allowed to appeal Engoron’s decision without putting up any money. In fact, he is already appealing; he filed his notice of appeal in February, the first business day after Engoron made the ruling official. And what Trump is actually being required to do – put up cash or a bond for the full amount of the judgment to secure a stay that would prevent James from collecting during the appeals process – is not “a first” or something “never done before.” The requirement is set out by New York law, and it is regularly applied in civil cases in the state.

James gave Trump a 30-day grace period before she starts to collect on the judgment. It ends on Monday, March 25, meaning that this date is a de facto deadline for Trump to find the cash or a bond unless a New York appeals court panel agrees to his request to allow him to avoid putting up the money until the end of the appeals process – which could be years from now. (The appeals court could alternately allow Trump to put up a smaller amount of money.)

If Trump did not secure a stay, James collected on the judgment, and then Trump eventually won the case on appeal, James would be required to return any collected money to Trump along with interest.

Donald J. Trump on Wednesday lost his initial bid for a New York appeals court to pause the more than $450 million judgment he faces in a civil fraud case, a decision that could expose him to financial peril.

Mr. Trump’s lawyers had asked the appeals court to allow him to post only a $100 million bond — a promise from an outside company that the judgment eventually will be paid — because securing one for the full amount was “impossible,” they said.

A single appellate court judge assigned to consider Mr. Trump’s request, Anil Singh, turned him down on Wednesday. Mr. Trump will try again next month with a panel of five appellate court judges, but for now, the former president is still on the hook to post a bond for the full amount of more than $450 million.

In a series of posts on his Truth Social platform after the decision, Trump railed against Judge Arthur Engoron and said there “were No Victims, No Damages, No Complaints.”

He went on to further criticize Engoron and New York Attorney General Letitia James (D) in multiple posts, saying the New York case was a “witch hunt” and that he was fined “$355 Million based on nothing other than having built a GREAT COMPANY.”

In his initial summary judgement ruling, which was handed down in September, Judge Engoron ordered some of Mr Trump's business licenses be rescinded — a punishment widely known as "corporate death penalty".

That order was on hold while Mr Trump appealed, but in Saturday's ruling, the judge has backed off from that move, describing it as being "no longer necessary".

The former president could be forced to pay the hundreds of millions of dollars in fines while he appeals.

Former prosecutor Mitchell Epner said this could take up to 36 months as the appeal process in New York tends to be very slow.

If he doesn't come up with the nearly half a billion dollars he has been fined to put in holding while on appeal, New York can begin the process of seizing his properties.

Of course, Trump won't be paying the fines and damages.  The Saudis, Russians, Jared, the RNC, and Trump rubes will.
