He distinguished between the contentious fight over alleged sexual assault by Kavanaugh and his decision as majority leader not even to consider President Barack Obama’s 2016 nomination of Merrick Garland to the Supreme Court in a presidential election year.

“You have to go back to 1880 to find the last time a vacancy created in a presidential election year on the Supreme Court was confirmed by a Senate of a different party than the president,” he added.
