He knows the committee dissolves at the end of the year. He's filing suit in south Florida and will appeal a denial, so essentially, he's not going to be testifying.
I don't think the committee really wanted to mess with him testifying anyway. What good could come from having him take the 5th or lie on every question? What they did by the subpoena was to block him from claiming he never had a chance to give his side of things.
