Take 'Em to the Hague

There are no indications the CIA is ready to turn things around, of course. CIA Director John Brennan went to extraordinary lengths to stymie and discredit the investigation. And now, he is rebuffing its conclusions.

Brennan’s statement Tuesday acknowledged “shortcomings” and “mistakes,” but reasserted “that interrogations of detainees on whom [enhanced interrogation techniques] EITs were used did produce intelligence that helped thwart attack plans, capture terrorists, and save lives.” He angrily rejected the report’s “inference that the Agency systematically and intentionally misled” Congress, the Executive Branch, and the public.”

And while they remain offstage by design, nothing in this report in any way exonerates the people who were running the show from the White House.

Other reports and works of journalism have clearly identified Vice President Dick Cheney as the prime mover in creating a torture regime that extended not just to the black sites, but to Abu Ghraib and Guantanamo and elsewhere. Cheney was no victim of misinformation; he was its architect.

And George W. Bush might have remained unfamiliar with the details until as late as 2006 – “According to CIA records, when briefed in April 2006, the president expressed discomfort with the ‘image of a detainee, chained to the ceiling, clothed in a diaper, and forced to go to the bathroom on himself’.” But he must have had some idea what Cheney and others were up to in the basement.

[Ex-Vice President Big Swinging Dick] Cheney, in his first public comments since [the torture report's] release, said he had read only summaries of it but denounced the report as “full of crap” and said it was a “flat-out lie” to suggest that President George W. Bush was kept in the dark about details of the program. “He knew certainly the techniques,” Mr. Cheney said on Fox News. “We did discuss the techniques. There was no effort on our part to keep him from that.”

And he'll be happy to shoot W in the face if he says otherwise.

Of course, Big Dick doesn’t think there’s anything wrong with torture.
“We asked the agency to go take steps and put in place programmes that were designed to catch the bastards who killed 3,000 of us on 9/11 and make sure it didn’t happen again, and that’s exactly what they did, and they deserve a lot of credit,” [Cheney] said, “not the condemnation they are receiving from the Senate Democrats.”

If I had to identify one key point from Tuesday, the thing that bothered me most about the narrative: Yes, the CIA goes off on its own and does things that political officials don’t know about; and yes, they mislead and lie to the committees that oversee them; and they do all these horrible things, the details of which are sometimes unknown to the political branches — but that’s how Washington wants it.

They’ve always wanted it that way. That’s what the CIA does. The CIA does the dirty work of the political branches of Washington and when they get caught, publicly, the ritual is that official Washington pretends that it was just these rogue CIA officers doing this without anyone’s knowledge or approval. It’s exactly what happened in the Iran-Contra scandal, which was ordered at the highest levels of the White House by President Reagan … but when they got caught, they said: Oh, it was Oliver North and these rogue CIA officers who were doing this without our knowledge!

That’s just the ritual Washington engages in; the CIA is kind of like their wild pit bull that they purposely let off leash. They don’t want to see the mauling but they know that it’s happening, and pretend they don’t know. And when it gets reported, they pretend that they’re horrified.
