The Hangover



Russian state TV is "brutally" mocking former President Donald Trump, following his indictment.

"During Friday’s broadcast of [Russian TV program] 60 Minutes, an AI-generated image of Trump in court donning an orange outfit was broadcast while panelists excitedly discussed the spectacle his arrest would cause," reported Julia Davis. "On Sunday, host Vladimir Solovyov and the panelists of Sunday Evening With Vladimir Solovyov wondered out loud if the former U.S. president would be elected in 2024 and joked about Trump sitting in the Oval Office sporting orange coveralls and handcuffs. Or maybe, Solovyov said, he would end up seeking asylum in Russia."

Dmitry Mikheyev, who formerly served as a senior fellow at the Hudson Institute but later returned to Russia, told the host that Trump is a beacon of conservative values who is being persecuted for his beliefs, against a backdrop featuring Trump behind bars and a scantily clad Stormy Daniels. Mikheyev described a 'deep civilizational divide' brewing in America on the basis of race, religion and politics — with Trump’s arrest exacerbating the situation. 'This is a serious conflict that is almost of a religious nature. And we’re certainly glad! If everything is bad in America,' Mardan said, 'It will impact us, but the enemy has to be destroyed!'"

Hours before Donald Trump walked into court for his arraignment, his son, Donald Trump Jr., posted links to a Breitbart article displaying photos of the presiding judge's daughter. It comes after Trump has made attacks on the judge, the prosecutor, and the prosecutor's wife.

The post that Trump Jr. made was part of an article attacking the judge because his daughter worked on the Biden/Harris campaign in 2020.

The lawyers were all cautioned to stop the incendiary rhetoric from the DA. The judge then asked that everyone involved in the case not use incendiary rhetoric.

Former President Donald Trump returned to Mar-a-Lago on Tuesday evening for a speech trashing the criminal case against him in New York.

[D]uring a rant about Democrats, Trump did something unusual — he admitted that he actually lost the 2020 presidential election, while alleging that Democrats kept information away from voters that would have changed the result.

"Democrats spied on my campaign. Remember that?" said Trump. "They attacked me with an onslaught of fraudulent investigations. Russia, Russia, Russia. Ukraine, Ukraine, Ukraine. Impeachment hoax number one, impeachment hoax number two. The illegal and unconstitutional raid on Mar-a-Lago, right here. Lying to the FISA courts. The FBI and DOJ relentlessly pursuing Republicans. Unconstitutional changes to election laws by not getting approvals from state legislators."

Above all, Trump said, "The millions of votes illegally stuffed into ballot boxes and all caught on government cameras. And just recently, the FBI and DOJ in collusion with Twitter and Facebook in order not to say anything bad about the Hunter Biden laptop from him, which exposes the Biden family as criminals in which according to the pollsters would have made a 17-point difference in the election result, and we needed a lot less than that, like about 16.9. It would have been in our favor. Not my favor, our favor, because our country is going to hell."

Calendar number one, indictment 71543 of 2023, People of the State of New York versus Donald J. Trump

The defendant, Donald J. Trump, falsified New York business records in order to conceal an illegal conspiracy to undermine the integrity of the 2016 presidential election and other violations of Election Laws. Beginning in about August of 2015, the defendant agreed with others to carry out an unlawful plan to identify and suppress negative information that could have undermined his candidacy for President. As part of that plan, a lawyer employed by the Trump Organization made a covert and illegal $130,000 payment at the defendant's direction. The purpose of the payment was to avoid negative attention to the defendant's campaign by suppressing information about an allegedly sexual encounter between defendant and an adult film actress.

After the election, defendant reimbursed the lawyer through a series of disguised monthly payments that hid the true nature of the payoff by causing a series of false business records in the records of the Trump Organization here in Manhattan, and even mischaracterized for tax purposes the true nature of the payment. Defendant falsified these New York business records with the intent to defraud, including the intent tocommit another crime, and to aid and conceal the commission of another crime.

This office has long prioritized protecting the integrity of business records maintained here in New York County.

When those records are falsified in service of another crime, it is a felony.

That is what this defendant did when he falsified business records in order to conceal unlawful efforts to promote his candidacy and that is why we are here.

And regarding Trump's incendiary rhetoric:
JUDGE MERCHAN: Certainly, the Court would not impose a gag order at this time even if it were requested.

Such restraints are the most serious and least intolerable on First Amendment rights. That does apply doubly to Mr. Trump, because he is a candidate for the presidency of the United States. So, those First Amendment rights are critically important, obviously.

I don't share your [Trump attorney's] view that certain language and certain rhetoric is just by frustration.

So, although I'm not going to issue a gag order and not something close to a gag order, I would encourage counsel on both sides, the People to please speak to your witnesses. Defense counsel, speak to your client and anybody else you need to, and remind them to please refrain, please refrain from making statements that are likely to incite violence or civil unrest.

Please refrain from making comments or engaging in conduct that has the potential to incite violence, createcivil unrest, or jeopardize the safety or well-being of any individuals.

Also, please do not engage in words or conduct which jeopardizes the rule of law, particularly as it applies to these proceedings in this courtroom.

This is a request I'm making. I'm not making it an order. But now that I have made the request, if I were to be handed something like this again in the future, I have to take a closer look at it.

So, I ask you to please discuss that with your client and the People also discuss it with your witnesses.
Prosecutors and defense attorneys are working together on a protective order that would prohibit Trump from using discovery materials for anything other than preparing his defense, eg. posting on social media or making money off it. They're going to file the agreement with the court. Read the entire transcript here. (Beware of several obvious typos or misheard/mistranslated words. Drives me crazy.)  

Also, correcting something in my previous post.  Listening to ABC during the arraignment, I reported that they said the judge told Trump he had to be present at all court hearings.  That's not true.  In fact, according to the transcript of the hearing, the judge informed Trump he has the right to refuse to be present.  And in addition, if he's disruptive in such a degree that it affects the judge's ability to preside over the case, the judge has the authority to remove him from the courtroom.
JUDGE MERCHAN: All right, if either one of those situations were to happen, and the case were to go to trial, we would go to trial without you.

If there were a verdict and that verdict were to be guilty, we would be able to take that verdict without you. And if there were to be a time for sentencing, we would be able to impose sentence without you. Do you understand?

TRUMP: Yes.
The ABC folks may have been talking imprecisely about the last back and forth when the defense suggested that to spare Manhattan the expense and spectacle incurred on arraignment day, they may not need Trump's presence on the day of motions set for December 4. The judge said he would deny that application, "in the interest of transparency and assuring the rules of law evenhandedly...in the same way I expect all other defendants to appear in court."  Or I may simply have misunderstood ABC's reporting.

And then...
Former President Trump was awarded about $121,972 in attorney fees from adult film star Stormy Daniels just hours after the former president appeared in court Tuesday for the first time in connection to hush money payments made to Daniels during the 2016 presidential campaign.

The Ninth Circuit Court of Appeals ordered Daniels to pay Trump for attorney fees endured during a 2018 defamation lawsuit that she filed against him. The lawsuit, which was dismissed later that year, was based on a tweet posted by Trump that suggested Daniels had lied about being threatened by an unknown man in 2011 in relation to an alleged affair she had with the former president.

I'm also going to guess they didn't have him remove his elevator shoes when they measured.  He has always insisted he's 6'3", but you can tell from pictures of him next to people whose height you know is 6'3" that he's not that tall.  The fake mug shot T-shirts they're hawking show him against a background that indicates his height is 6'5".  

The grift is incredible...


Lindsey hopes he'll get a return on this investment when his time comes in the defendant's chair.  He's going to be sorely disappointed.
